Why is there a filing fee? Isn’t the expungement filed in my original case(s)?

Expungements are not part of the original criminal case filed by the prosecutor’s office at the time of the offense. They are a new civil case that we are opening on your behalf. Indiana Law requires the payment of a filing fee to the clerk when filing any new case. That fee is charged on a per-county basis. This fee does not apply whenever the petition only includes cases with no conviction. You will deposit the necessary fee into our trust account, and we are required to pay that fee on your behalf when we file your expungement petition(s).
